Roll Call – Councilor Graney, McNabb, Brower and Mayor Quill – Present Councilor Smith arrived after roll.

Staff – Mark Palesh, City Manager, Debra McCormick, City Clerk, John Rossi, Corporation Counsel, Lisa Green, Comptroller, Mike Hammon, Fire Chief, Gary Giannotta, Police Chief, Karen Green, Human Resource Director, Laurie D’Arpino, Secretary to the Mayor.

Pledge of Allegiance to the Flag – All stood for the Pledge of Allegiance.

Moment of Silent Prayer or Reflection – Mayor Quill asked everyone to remain standing for a moment of silent prayer or reflection.  He asked that Steve Netti, Cayuga County Legislator and his family be remembered.

Mayor Quill opened the PUBLIC HEARING regarding Local Law #1 of 2008 of the City of Auburn, repealing the cents per gallon rate of sales and compensating use taxes on motor fuel and diesel motor fuel.  He asked anyone wishing to speak on this topic to come forward. There were no speakers.  Mayor Quill announced that the Public Hearing would remain open if anyone should come forward later in the meeting.

Public to be Heard - Mary Lou Picciano 32 Cayuga St. commented on her issues with the Police Departments conduct.

City Manager’s Report –
The City Manager reported on the following:
·       He asked that Item 12 A be pulled.
·       Streets lights that are out are being replaced per Councilor McNabb’s request.
·       The 2008-09-budget process has begun.

Report of City Officials – Mayor Quill reported that he along with Councilor McNabb and City Clerk Debra McCormick attended the New York State Conference of Mayors Legislative workshop in Albany earlier in the week.

Resolutions  

Appointment Resolution #19 of 2008 - PULLED

Appointment Resolution #20 of 2008 authorizing re-appointment of Thomas Shamon as part-time City Court Judge, said term to expire on April 17, 2014. Vote:  Councilor Graney, McNabb, Smith, Brower and Mayor Quill, aye.  PASSED.

Council Resolution #21 of 2008 authorizing a Public Hearing to be held on Thursday, March 13, 2008 at 6:00 p.m. regarding Local Law #2 of 2008 amending Local Law #2 of 2007 establishing residency and proximity restrictions in the City of Auburn for Level III Sex Offenders.  Vote:  Councilor Graney, McNabb, Smith, Brower and Mayor Quill, aye.  PASSED.

Mayor Quill closed the Public Hearing at 6:20PM.

Local Law

Local Law #1 of 2008 of the City of Auburn, New York, repealing its cents per gallon rate of sales and compensating use taxes on motor fuel and diesel motor fuel, thus restoring its percentage rate of such taxes, pursuant to the authority of Article 29 of the Tax Law of the State of New York. Vote:  Councilor Graney, McNabb, Smith, Brower and Mayor Quill, no.  DEFEATED.


The City Clerk read “Local Law #2 of 2008 amending Local Law #2 of 2007 establishing residency and proximity restrictions in the City of Auburn for Level III Sex Offenders” into the record for a first reading.
